LIABILITY RELEASE AND WAIVER AGREEMENT
This Release and Waiver of Liability (the “Release”) is executed on [Date] by the purchaser (the “Purchaser”) in favor of DNA Physical Therapy Corp, a corporation organized and existing under the laws of California, USA], its employees, agents, and representatives (collectively, “DNA Physical Therapy”).
By purchasing or using any online product or service provided by DNA Physical Therapy Corp (the “Product”), the Purchaser agrees to the following terms:
1. Acknowledgment of Risks
The Purchaser acknowledges and agrees that:
- The information, exercises, and instructions provided in the Product are for educational purposes only and are not intended to replace professional medical advice, diagnosis, or treatment.
- Participation in physical exercises and the use of any information from the Product may involve physical exertion, injury, or unforeseen complications. It is the Purchaser’s responsibility to consult a healthcare professional before engaging in any activities suggested by the Product.
2. Release of Liability
The Purchaser, on behalf of themselves and their heirs, assigns, and legal representatives, hereby:
- Waives, releases, and forever discharges DNA Physical Therapy and its employees, agents, and affiliates from any and all claims, liabilities, demands, or causes of action, known or unknown, arising out of the use of the Product.
- Agrees not to hold DNA Physical Therapy responsible for any injuries, losses, or damages that may occur as a result of the Purchaser’s use of the Product, including but not limited to injury, disability, or death.
3. No Guarantees
The Purchaser understands that:
- DNA Physical Therapy makes no warranties or guarantees regarding the results that may be obtained from using the Product.
- The Product is provided on an “as-is” basis, and the Purchaser assumes full responsibility for their use of the information, including any risk of injury or harm.
4. Indemnification
The Purchaser agrees to indemnify and hold harmless DNA Physical Therapy and its employees, agents, and affiliates from any claims, losses, or expenses (including attorneys’ fees) arising out of the Purchaser’s use of the Product.
5. Governing Law
This Release shall be governed by and construed in accordance with the laws of the State of California, without giving effect to its conflict of law principles.
6. Severability
If any provision of this Release is found to be invalid or unenforceable, the remainder of this Release will remain in full force and effect.
7. Entire Agreement
This Release constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior agreements, whether written or oral, related to the same.
8. Acknowledgment
The Purchaser acknowledges that they have read and fully understand the terms of this Release and that they voluntarily agree to these terms.
